1. SCOPE
These Terms and Conditions apply to all orders placed by consumers and businesses through the online store Cozy Little Star, operated by:

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession.
A business is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.
For consumers, mandatory consumer protection provisions of the country in which they habitually reside remain unaffected where applicable.

Cozy Little Star is the trading name used for the online store.
3. CONCLUSION OF CONTRACT
The presentation of products in our online store does not constitute a legally binding offer, but an invitation to place an order.
You may add products to your shopping cart and review or correct your information before submitting your order.
By clicking the final order button, you submit a binding offer to purchase the products contained in your shopping cart.
After placing your order, you will receive an electronic order confirmation. The purchase contract is concluded when we expressly accept your order or otherwise confirm acceptance of the order, including through a corresponding shipping confirmation.
We reserve the right to reject an order where legally permissible, for example if a product is unavailable, payment cannot be processed or there is an obvious pricing or product information error.
4. CONTRACT LANGUAGE AND STORAGE
The contract language is English unless another language is expressly offered during the ordering process.
The order information and these Terms and Conditions will be made available electronically. Customers should save their order confirmation and the applicable Terms and Conditions for their records.
5. PRICES
The prices displayed in our online store are the prices applicable at the time the order is placed.
For customers within the European Union, prices displayed to consumers include applicable VAT where required by law.
Any additional shipping costs will be clearly displayed before the customer submits the order.
For deliveries outside the European Union, additional customs duties, import taxes, fees or other charges may be imposed by the destination country. Unless expressly stated otherwise during checkout, such charges are not collected by us and may be payable by the recipient to the relevant authorities or service providers.
6. PAYMENT
The payment methods available for an order are displayed during checkout.
Depending on the customer's country and availability, these may include payment cards, digital wallets, PayPal, Klarna or other payment methods.
Individual payment methods may be provided by third-party payment service providers and may be subject to their respective terms and conditions.
Unless otherwise stated, payment is due upon conclusion of the contract.
7. SHIPPING AND DELIVERY
We deliver to the countries and regions made available for shipping during checkout.
Available shipping methods, shipping costs and estimated delivery times are displayed during the ordering process.
Any delivery dates or delivery periods stated in the online store are estimates unless a specific delivery date has expressly been agreed as binding.
Delivery times may be affected by circumstances outside our reasonable control, including customs procedures, carrier disruptions or force majeure.
We will inform customers of material delays where required and reasonably possible.
8. TRANSFER OF RISK
For consumers, the risk of accidental loss of or damage to the goods generally passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, receives the goods.
This does not affect any different rule required by mandatory applicable consumer law.
Where a consumer independently commissions a carrier that was not offered by us, statutory provisions regarding transfer of risk apply.
9. RIGHT OF WITHDRAWAL
Consumers residing in the European Union, European Economic Area or other jurisdictions providing a statutory right of withdrawal may have the right to withdraw from a distance contract within the applicable statutory period.
For consumers subject to EU withdrawal rules, the withdrawal period is generally 14 days from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
The details concerning the right of withdrawal, its exercise, applicable exceptions and the consequences of withdrawal are set out in our separate Withdrawal Policy / Cancellation Policy.
Mandatory statutory withdrawal rights remain unaffected by these Terms and Conditions.
10. RETURNS
Returns based on a statutory right of withdrawal are governed by our Withdrawal Policy.
Any voluntary return policy offered by Cozy Little Star applies in addition to statutory consumer rights and does not restrict those rights.
Customers are responsible for handling returned products in accordance with the requirements described in the applicable return or withdrawal policy.
Nothing in a voluntary return policy limits statutory rights relating to defective or non-conforming goods.
11. DEFECTIVE PRODUCTS AND LEGAL GUARANTEE
Consumers are entitled to the statutory rights applicable to defective or non-conforming goods.
In particular, consumers within the European Union benefit from the mandatory legal conformity and warranty rights applicable under the relevant consumer protection laws.
Nothing in these Terms and Conditions excludes, restricts or replaces mandatory statutory rights relating to defective goods.

Please provide your order number and, where appropriate, photographs or other information that may help us assess the issue.
12. PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, colours and other information displayed in our online store are accurate.
However, minor variations may occur. In particular, colours may appear differently depending on the customer's screen and device settings.
Such variations do not affect the customer's statutory rights where the goods do not conform to the contract.
Obvious typographical or technical errors may be corrected where permitted by law.
13. AVAILABILITY
Products are offered subject to availability.
If a product becomes unavailable after an order has been placed and we are unable to fulfil the contract, we will inform the customer without undue delay and refund any payments already received for the affected product where required.
14. RETENTION OF TITLE
Goods remain our property until the purchase price has been paid in full, to the extent permitted by applicable law.
15. LIABILITY
We are liable without limitation where liability is mandatory by law, including for damage caused intentionally or through gross negligence and for injury to life, body or health caused by an intentional or negligent breach of duty.
We are also liable in accordance with applicable statutory provisions for breaches of material contractual obligations.
In cases of slight negligence involving material contractual obligations, liability may be limited to foreseeable damage typical for the contract to the extent permitted by law.
Mandatory liability under applicable product liability laws and other mandatory statutory provisions remains unaffected.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
16. INTELLECTUAL PROPERTY
Unless otherwise indicated, content made available through the Cozy Little Star online store, including our own texts, graphics, photographs, logos, designs and other materials, is protected by applicable intellectual property laws.
Content may not be reproduced, distributed, commercially exploited or otherwise used beyond what is permitted by law without the permission of the respective rights holder.
Third-party trademarks, logos and other protected materials remain the property of their respective owners.
17. CUSTOMER ACCOUNTS
Where customer accounts are available, customers are responsible for providing accurate information and maintaining the confidentiality of their login credentials.
Customers must notify us if they become aware of unauthorized use of their account.
We may restrict or terminate accounts where necessary to prevent fraud, abuse or unlawful use, subject to applicable law.
18. PERSONAL DATA
Information concerning the collection and processing of personal data is provided in our Privacy Policy.
Personal data is processed in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) where applicable.
Our online store is hosted using Shopify. Additional service providers, including payment and logistics providers, may process personal data where necessary to provide their respective services.
19. DISPUTE RESOLUTION
The European Union's former Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025. References to the former EU ODR platform are therefore not included in these Terms.
Where legally required, we provide information regarding our willingness or obligation to participate in dispute resolution proceedings before a consumer arbitration body separately in our legal information.
20. APPLICABLE LAW
The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law does not deprive them of mandatory consumer protection provisions granted by the law of the country in which they have their habitual residence where such provisions apply.
21. SEVERABILITY
If any provision of these Terms and Conditions is or becomes invalid or unenforceable, the remaining provisions remain unaffected.
Mandatory statutory provisions apply in place of any invalid or unenforceable provision.
22. CHANGES TO THESE TERMS
We may amend these Terms and Conditions for future transactions where necessary.
The version applicable to an order is the version in effect when the customer places the relevant order.
Changes made after an order has been concluded do not retroactively alter the contractual terms of that order unless legally permitted and agreed where required.
